Article 1: General provisions

Article 3: Offer

Article 4: Online purchases
To purchase an item, and therefore to place an order, you will have to add the item to your shopping cart. You can then choose the number of items you want to order. Article 5: Delivery and execution of the agreement
The delivery of the ordered items will be sent as soon as possible after receipt of payment. This is usually within 5 working days after placing the order.

Incorrect delivery addresses are the responsibility of the customer and may lead to additional delivery costs.

The stated sales prices are always exclusive of delivery costs, unless stated otherwise.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately by the Customer to LoLivia, by e-mail to info@lolivia.eu

The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by LoLivia.

Article 6: Retention of title
The delivered items remain the exclusive property of LoLivia until full payment has been made by the Customer.

The Customer undertakes, if necessary, to point out to third parties LoLivia's retention of title, eg to anyone who would seize the items not yet fully paid for.

Article 7: Right of withdrawal
The provisions of this article only apply to Customers who purchase items online from LoLivia in their capacity as consumers.

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without stating reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

All returned items are carefully examined. The basic principle here is that the consumer may only inspect the article as he would be allowed to do in a store. Returned items may be tried on, but must not have been used. We also kindly ask you to return the items with the label attached. Please do not store our items in smoky areas, in the kitchen or near pets. When an item has undergone a decrease in value due to the use of the Customer, this will be charged to the Customer.

Article 8: Warranty
Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee is valid from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact customer service (info@lolivia.eu) and return the item to LoLivia at its expense.

In the event of a defect, the Customer must inform LoLivia as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after its discovery. Afterwards, any right to repair or replacement lapses.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless proven otherwise by the Customer.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to LoLivia, in the event of non-payment or late payment from the date of default, the Customer owes an interest of 10% per year on the unpaid amount, by operation of law and without notice. In addition, by operation of law and without notice, the Customer owes a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Notwithstanding the foregoing, LoLivia reserves the right to take back items that are not (fully) paid for.
